These terms and conditions apply to a Vacation Ventures program called "Airfare's On Us" as posted at http://vacationventures.com/738_online/terms.cfmUnder this program, the purchase of accomodations from Vacation Ventures at specified prices entitles the certificate holder to free airfare for two to the selected destination.
What is Included in This Offer
This offer is valid for two people, at least one of whom must be 21 years of age or older, to receive round-trip airline tickets from select departures to a choice of one of the specific destinations listed within this brochure, provided the hotel accommodations are purchased through Vacation Ventures, Inc. (VVI) for the minimum number of consecutive nights stated. The valid departure airports and corresponding minimum number of nights hotel stay required are listed under each destination choice in this booklet and will vary based on destination. The User must stay in one or more of the hotels listed and pay the priced as stated. This offer may not be used in conjunction with any other offer, promotion or discount. No refund for any unused portion of this offer will be made. This offer is redeemable for services only.
Hotel Room Rates
Rates are per room/per night, based on one or two people sharing a room. Rates are based on rack rates provided to us by the hotels (excluding internet rates) at the time of printing. No special promotional discounts apply. Rates and hotels are subject to change.
Departure Airports
Valid departure airports are listed under each specific destination along with the corresponding minimum number of nights hotel stay required. Valid departure airports will vary based on destination. You may request to depart from an airport that is not listed under your destination of choice provided you are willing to pay a flight surcharge determined by the difference, if any, between VVI's air cost from a nearby valid departure airport and the actual cost of your airline tickets. If you have any question about the state in which a listed airport is located, call Customer Service at 407-839-1006, 9am-1pm and 2-5pm est, M-F.
General Information
The airline tickets issued to you under this offer are for seats in the coach section of the plane. VVI's availability under its contractual agreements may be limited to certain fare classifications depending upon departure and destination. All rooms are run-of-house (standard), unless stated otherwise under the hotel's listing. Room location will be at the hotel's discretion. No group tours are permitted. A group tour is defined as three or more certificate holders requesting to travel together utilizing three or more Reservation Request Forms and having the same requested departure date and destination.
Sorry, no pets allowed.
This certificate may be distributed by authorized businesses only, free of charge, as a promotional device. It may not be sold or resold and any such sale will invalidate any redemption rights hereunder.
What is NOT included in this offer
Any item which is not specifically stated as included is not included. This offer does not include meals (unless specifically stated as being included in the individual hotel listing). This offer does not include ground transportation, inter-island airfare (if applicable), fuel surcharge (if applicable), any and all taxes, insurance, baggage handling, laundry, telephone calls, rollaway beds, room service charges or any personal items charged to the room, optional excursions, fees for any recreational activities, or any item of a purely personal nature.
Reservation Requirements
You may request reservations on-line by completing the Reservation Request Form found at www.vacationventures.com, or by completing and mailing the Reservation Request Form located at the back of this booklet to VVI at the address indicated. In either case, VVI must receive the completed Reservation Request Form at least 45 days in advance of your requested departure date. Please allow for possible mail delays. If at all possible, please give more than 45 days' advance notice, as all reservation requests are processed on a first come/first served basis and are subject to VVI's contractual availability. VVI will make every effort to confirm your first choice departure date and destination.
Certain destinations may only allow for specific departure days of the week; this information, if applicable, is located on the destination page. Additionally, some departures/destinations requiring less than a 7-night stay may require a Saturday night stay.
Your requested travel period may not begin, end or overlap any black-out period as follows:
The weeks immediately before and after Christmas and Easter in all destination choices, and June 1-July 15 and September 1-15 to London, Paris or Spain.
All reservations must be requested, booked and purchased through VVI-not the hotel.
Reservation Availability
Vacation Ventures has a "free sell" relationship with its suppliers. This allows VVI to process reservation requests as "available" until its 45 day cut-off or until a supplier (hotel and/or airline) notifies VVI that certain dates are unavailable. In the rare circumstance that VVI receives notification from its supplier(s) that your requested date is unavailable after VVI has already processed your request as available and sent you a Reservation Availability Statement, but before issuing your tickets and voucher, VVI reserves the right to offer alternate accommodations or travel dates.
Payment Requirements
Do not send any money with your Reservation Request Form. Upon receipt of your correctly completed Form, VVI will determine availability. If your requested destination/date is available, a Reservation Availability Statement will be sent to you outlining the applicable deposit or full payment required to secure your reservation. If the Statement requires you to submit an initial deposit, the remaining balance must be received by VVI no later than 45 days in advance of your confirmed departure date. Requests to travel to Mexico, London, Paris or Spain may require full payment immediately upon confirmation. Requests to travel during the month of March, Thanksgiving Week, President's Birthday Week or other major holiday periods may require full payment more than 45 days in advance of departure.
If you make your reservations on-line, you will be required to submit the original, signed Reservation Request Form included in this booklet with your hotel payment.
Payment Form
All monies paid to VVI must be in the form of a cashier's check or money order, made payable to VVI Trust Account.
All monies submitted to VVI are held in escrow (VVI Trust Account) pending payment to suppliers on your behalf and which account is administered by a third-party escrow agent.
Mutual Agreement
Once the Reservation Request Form has been accepted by VVI and a Reservation Availability Statement has been issued, an agreement will have been made. VVI agrees to provide the travel services offered under the section "What Is Included In This Offer" providing you agree to comply with the Terms & Conditions of this offer, including submitting payment in the proper form by the due date.
If you wish to cancel this agreement, you may do so by failing to deliver any and all deposits or balances due under the Reservation Availability Statement within fifteen (15) calendar days of its issuance. If you wish to proceed under this agreement, you must deliver, and VVI must receive, any and all deposits or balances due under the Statement within fifteen (15) calendar days of its issuance.
Extra Persons
Generally, up to two extra persons may share the same room with the two travelers on this offer. An extra person hotel charge may apply for a third or fourth person, based on the age of the extra person and the specific hotel's extra person policy. VVI will be happy to arrange airfare for any extra persons at the lowest fare available at the time of booking (since the two included airline tickets are not ordered or issued until VVI has received and processed your timely hotel balance payment, extra airline tickets cannot be booked or purchased before then).
Extra Nights & Extended Return Flight Request
You may book and purchase extra nights through VVI and pay the rate as stated. Or, you may stay extra nights on your own. Any extra night purchases through VVI or any request to extend the return flight to accommodate extra nights not purchased through VVI may be subject to a flight surcharge if the request causes VVl's air cost to increase. Because airline tickets are not issued until full payment is received, the amount of any applicable surcharge with respect to an extended return flight will not appear on your Reservation Availability Statement.
Change Requests & Change Fees
Once a Reservation Request Form has been received, VVI does not allow name changes. Date and destination changes may be made by submitting a request in writing along with a $30 change fee. Change requests are subject to availability and must be in compliance with the Terms & Conditions; i.e.: minimum 45 days' advance notice, travel completed by expiration date and any other restrictions or requirements stated.
Change requests are not subject to a change fee if the written change request is received within fifteen (15) calendar days of the issuance of the Reservation Availability Statement.
Change requests are not allowed once airline tickets have been ordered/issued.
Cancellation Policy & Travel Insurance
Cancellation will automatically occur if your deposit or full payment, as the case may be, in its proper form is not received by VVI by the due date stated in the Reservation Availability Statement, or if any payment is uncollectible due to stop payment order or for any reason.
To cancel any confirmed reservation, you must do so in writing addressed to:

In the event of cancellation prior to order/issuance of airline tickets, you may apply monies previously paid (less any cancellation penalties assessed by airline and/or hotel) towards a future booking, subject to the Terms & Conditions and a re-booking fee of $30, OR you may request a refund of monies previously paid to VVI (less a cancellation penalty of $100 plus applicable penalties assessed by the airline and/or hotel). Refund is subject to a written refund request received by VVI prior to the expiration date of the certificate.
Written cancellations received after airline tickets have been ordered/issued or no-shows are not eligible for re-booking and are not eligible for a refund of any kind.
Price Guarantee
Confirmation does not constitute a price guarantee. All hotel taxes, airline related taxes and fuel surcharges (if applicable) and any other applicable taxes are subject to increase at any time without notice. VVI reserves the right to invoice such increases if and when they occur regardless of whether or not a reservation is paid in full. Be aware that hotel prices in general may increase at any time without notice. VVI only guarantees hotel prices for reservations that are paid in full at the time a hotel price increase occurs. VVI is under no obligation to provide a grace period during which reservations not fully paid may be paid in full in order to qualify for a price guarantee.
Responsibility
VVI, not the issuing Sponsor, is fully and solely responsible for the fulfillment of the offer(s) contained in this booklet/certificate. VVI is not responsible for the willful or negligent acts and/or omissions by the suppliers or their respective employees, agents, servants or representatives including, without limitation, their failure to deliver or their partial or inadequate delivery of services.
All documents, including coupons, receipts and tickets are issued subject to the Terms and Conditions specified by the suppliers and/or air carriers. By utilizing the travel services of the suppliers, you agree that neither VVI, the Sponsor, nor any representative of either, shall be liable for any accident, injury, property damage or personal loss to you or to those traveling with you in connection with any accommodations, transportation or other travel services resulting directly or indirectly from any occurrences or conditions beyond their control including, but not limited to, acts of terrorism, defects in vehicles, breakdown in equipment, strikes, theft, delay or cancellation of or changes in itinerary or schedules.
VVI assumes no responsibility for any verbal or written representation made in conjunction with this offer by an agent, distributor, person or entity other than those specifically contained within the Terms & Conditions of this certificate. These promotional vacations are planned in advance. If, between the planning time and the actual vacation, circumstances beyond VVI's control require changes to be made, VVI reserves the right to vary itineraries and substitute components of the offered vacation. All travel documents as well as customs regulations, including having and showing an acceptable form of Proof of Citizenship when traveling outside the U.S., are the User's responsibility.
The submission of the enclosed Reservation Request Form to VVI constitutes consent to all provisions of the Terms & Conditions contained within this certificate. Vacation Ventures, Inc. is registered with the State of Florida as a Seller Of Travel, Registration No. 10077.
All matters arising out of the receipt and redemption of or travel under this certificate shall be construed and enforced in accordance with the laws of the State of Florida. It is agreed by and between the holder of this certificate and VVI that the venue of all disputes and matters whatsoever arising under, in connection with or incident to the receipt and redemption of or travel under this certificate shall be litigated, if at all, in and before a Court of competent jurisdiction in the 9th Judicial Circuit in Orange County, Florida U.S.A. to the exclusion of the Courts of any other State. It is also agreed by and between the holder of this certificate and VVI that the party prevailing in any legal action shall be entitled to an award of all legal costs and expenses including a reasonable sum for attorney fees including legal fees and costs on appeal. Vacation Ventures does not assume responsibility for any errors or omissions in the content of any hotel or destination descriptions, nor for any printing errors contained on the pages within this booklet. The terms under which you agree to accept this vacation cannot be changed or amended except in writing, signed by an authorized officer of Vacation Ventures, Inc.
This offer is void where prohibited by law.
